REFORM OF THE INTERNATIONAL HEALTH REGULATIONS (WHO) APPROVED
A few hours ago, the new amendments to the WHO's International Health Regulations were approved.
The treaty on pandemics has not been approved, but it has been approved.
Anyone who has studied it will know that it was an agreement aimed primarily at regulating the economic conditions between the WHO, the States Parties, i.e. the individual countries, and the private companies involved in the production of health products worldwide. This included patents.
It was not approved because the pharmaceutical companies did not want it, nor did many countries, because intellectual property and the economic rights it implies could disappear for an indefinite period.
However, the International Health Regulations, particularly the one that has been approved, affect the regulation of all the social and health rules that they want to implement for people, in the event of a pandemic emergency or public health emergency.
A pandemic or public health emergency of international importance will be declared unilaterally by the WHO DIRECTOR-GENERAL (article 12), who will personally appoint the Committee of Experts (article 47).
An obligation is introduced for countries to communicate what they consider to be disinformation (article 52, vi, annex 1), something undefined and which they assume to be risks, with the possibility of going against freedom of expression, a fundamental human right protected by all constitutions.
The WHO's enforcement mechanism is also strengthened in each country, through the creation of the NATIONAL IHR AUTHORITY, which is an entity designated or established by the State party at national level, to coordinate the implementation of this regulation within the jurisdiction of each country (article 1/article 4), so that domestic legislation can develop it.
On the other hand, there are many possibilities for declaring a pandemic emergency.
A pandemic is a public health emergency of international concern caused by a communicable disease that has, or has a high probability of having, a wide geographical distribution (article 1).
The declaration of a pandemic can therefore be based on only one possibility.
Temporary recommendations, which are no longer "non-binding", may continue to be issued by the WHO Director-General, even after the end of a pandemic emergency or a public health emergency of international concern (article 15), and may include quarantines, isolation, vaccination requirements, banning entry to suspected persons, contact tracing, etc. (article 18).
Let's not forget that the purpose and scope of this regulation is the prevention, PREPARATION, protection, control and public health response to the international spread of disease (article 2).
Consequently, this opens up the possibility of interfering in people's lives, whether or not there is any real danger.
